1. Acceptance of Terms
By accessing and using BuyingPH REL ("the Platform"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.
These Terms of Service constitute a legally binding agreement between you and BuyingPH REL regarding your use of the Platform.
2. User Accounts and Roles
BuyingPH REL supports three types of user accounts:
- Buyers: Individuals seeking to purchase real estate properties
- Brokers: Licensed real estate professionals with valid PRC licenses
- Salespersons: Real estate professionals working under licensed brokers
All users must provide accurate and complete information when creating an account. You are responsible for maintaining the confidentiality of your account credentials.
3. Property Listings
Property listings on BuyingPH REL must be accurate, complete, and comply with all applicable laws and regulations. Brokers and salespersons are responsible for the accuracy of their listings.
We reserve the right to remove any listing that violates our policies or applicable laws without prior notice.
4. Custom Search and AI Features
4.1 Weekly Search Limits
All users (buyers, brokers, and salespersons) are subject to weekly limits on the number of custom searches they can save. The current limit is configurable by our administrators and applies to all user types equally.
Weekly limits reset every Monday at 12:00 AM Philippine Time. Users will be notified when they approach or reach their weekly limit.
4.2 Changes to Search Limits
We reserve the right to modify search limits at any time without prior notice. Changes to search limits may be made for:
- System performance optimization
- Fair usage policy enforcement
- Service improvement purposes
- Technical maintenance requirements
Users will be informed of significant changes to search limits through platform notifications or email communications.
4.3 Search Data and Privacy
Custom search data is stored securely and used only to provide matching property notifications and improve our services. Search data is not shared with third parties without your explicit consent.
4.4 AI-Generated Content
BuyingPH REL provides AI-powered features including automatic title generation for property listings. By using these features, you acknowledge and agree that:
- The quality of AI-generated content depends on the accuracy and completeness of the input data you provide
- AI-generated titles are limited to a maximum of 50 characters, which may affect the quality and completeness of the generated content
- BuyingPH REL is not responsible for any misuse, inaccuracy, or inappropriate content generated by AI features
- We reserve the right to change, update, or discontinue AI models and features at any time without prior notice
- You are solely responsible for reviewing and approving any AI-generated content before publishing or using it
- AI-generated content should be used as a starting point and may require human review and editing for accuracy and appropriateness
While we strive to provide helpful AI features, users should exercise their own judgment and conduct appropriate due diligence when using AI-generated content for property listings or other purposes.
5. User Conduct
You agree not to use the Platform to:
- • Violate any applicable laws or regulations, including real estate laws and the Data Privacy Act
- • Infringe on the rights of any third party
- • Harass, abuse, or harm another person, including other users of the Platform
- • Send spam, unsolicited messages, or engage in deceptive marketing practices
- • Interfere with the proper functioning of the Platform or attempt to bypass security measures
- • Attempt to access areas of the Platform that you are not authorized to access
- • Use the Platform for any fraudulent or illegal purpose
- • Scrape, data-mine, or extract information from the Platform without our express permission
- • Impersonate another person or misrepresent your affiliation with any person or entity
6. Intellectual Property
The Platform and its original content, features, and functionality are owned by BuyingPH REL and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.
6.1 User Content
By posting content on the Platform, including property listings, descriptions, and images, you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such content in connection with providing and promoting the Platform. You represent and warrant that you own or have the necessary rights to grant us this license.
6.2 Property Images and Media
You must have the right to use and share any images, videos, or other media you upload to the Platform. Do not upload media that infringes on others' copyright or privacy rights. We reserve the right to remove any content that violates these Terms or that we believe is inappropriate.
7. Messaging and Communications
Our Platform facilitates communication between buyers and real estate professionals. By using our messaging system, you agree:
- To communicate in a professional and respectful manner
- Not to use the messaging system for spam, harassment, or any illegal purpose
- That messages sent through the Platform may be monitored for quality assurance and security
- That we may send you notifications related to your account, inquiries, and Platform updates
8. Disclaimer of Warranties
Important Legal Notice
THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that the Platform will be uninterrupted or error-free, that defects will be corrected, or that the Platform or the servers that make it available are free of viruses or other harmful components.
We do not guarantee the accuracy or completeness of property listings, broker credentials, or other content on the Platform. While we implement verification processes, users should conduct their own due diligence before making property decisions.
9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BUYINGPH REL SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:
- • YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE PLATFORM
- • ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE PLATFORM, INCLUDING PROPERTY LISTINGS OR BROKER COMMUNICATIONS
- • ANY CONTENT OBTAINED FROM THE PLATFORM
- • UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT
- • ANY PROPERTY TRANSACTIONS OR NEGOTIATIONS THAT RESULT FROM USING OUR PLATFORM
- • ANY ISSUES WITH PROPERTY VERIFICATION OR BROKER CREDENTIALS
10. Indemnification
You agree to indemnify, defend, and hold harmless BuyingPH REL and its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including but not limited to attorney's fees) arising from:
- • Your use of the Platform
- • Your violation of these Terms
- • Your violation of any rights of a third party
- • Your conduct in connection with the Platform
- • Any property listings or content you post on the Platform
- • Any transactions or negotiations you engage in as a result of using the Platform
11. Governing Law
Jurisdiction and Applicable Law
These Terms shall be governed by and construed in accordance with the laws of the Republic of the Philippines, without regard to its conflict of law provisions. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located within Metro Manila, Philippines.
12. Changes to Terms
Terms Modification Policy
We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Platform after those revisions become effective, you agree to be bound by the revised Terms.
